{"id":17917,"date":"2025-10-16T11:23:19","date_gmt":"2025-10-16T11:23:19","guid":{"rendered":"https:\/\/belzuz.com\/?p=17917"},"modified":"2025-10-16T11:23:19","modified_gmt":"2025-10-16T11:23:19","slug":"portugal-revision-des-loyers-quoi-de-neuf-en-2026","status":"publish","type":"post","link":"https:\/\/belzuz.com\/en\/portugal-revision-des-loyers-quoi-de-neuf-en-2026\/","title":{"rendered":"Portugal \u2013 revision des loyers: Quoi de neuf en 2026?"},"content":{"rendered":"<p><strong>Publication du coefficient de r\u00e9\u00e9valuation des loyers pour l\u2019ann\u00e9e civile 2026<\/strong><\/p>\n<p>Le coefficient de r\u00e9\u00e9valuation des loyers pour l\u2019ann\u00e9e 2026 a \u00e9t\u00e9 publi\u00e9 par l\u2019Institut National de la Statistique (INE), conform\u00e9ment \u00e0 l\u2019Avis n. \u00ba 23174\/2025\/2, en application de l\u2019article 1077.\u00ba du Code civil et de l\u2019article 24.\u00ba du Nouveau R\u00e9gime du Bail Urbain (NRAU).<\/p>\n<p>Le coefficient applicable est de <strong>1,0224<\/strong>, ce qui repr\u00e9sente une <strong>augmentation maximale de 2,24 %<\/strong> par rapport au loyer actuellement en vigueur.<\/p>\n<p><strong>Conditions l\u00e9gales pour appliquer la r\u00e9\u00e9valuation<\/strong><\/p>\n<p>La r\u00e9\u00e9valuation du loyer constitue un droit potestatif du bailleur, mais elle n\u2019est pas automatique.<\/p>\n<p>Pour qu\u2019elle produise ses effets juridiques, les conditions suivantes doivent \u00eatre respect\u00e9es :<\/p>\n<ul>\n<li>Dur\u00e9e minimale du contrat : au moins un an doit s\u2019\u00eatre \u00e9coul\u00e9 depuis la signature du contrat ou depuis la derni\u00e8re r\u00e9\u00e9valuation ;<\/li>\n<li>Notification pr\u00e9alable : le bailleur doit informer le locataire au moins 30 jours \u00e0 l\u2019avance, en pr\u00e9cisant le nouveau montant du loyer, le coefficient appliqu\u00e9 et la date d\u2019entr\u00e9e en vigueur ;<\/li>\n<li>Forme de la notification : la communication doit \u00eatre faite par \u00e9crit, conform\u00e9ment \u00e0 l\u2019article 1077.\u00ba, n\u00ba 2 du Code civil, de pr\u00e9f\u00e9rence par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception.<\/li>\n<\/ul>\n<p><strong>Contrats avec clause de r\u00e9\u00e9valuation<\/strong><\/p>\n<p>Dans les contrats pr\u00e9voyant une clause de r\u00e9\u00e9valuation annuelle, le coefficient publi\u00e9 par l\u2019INE peut \u00eatre appliqu\u00e9 directement, \u00e0 condition que les exigences l\u00e9gales et formelles soient respect\u00e9es.<\/p>\n<p><strong>R\u00e9gimes sp\u00e9ciaux et exceptions<\/strong><\/p>\n<p>Les contrats sign\u00e9s avant 1990, ainsi que les situations couvertes par des r\u00e9gimes transitoires ou de protection du locataire, peuvent \u00eatre soumis \u00e0 des limitations sp\u00e9cifiques.
