{"id":21381,"date":"2026-05-29T06:24:29","date_gmt":"2026-05-29T05:24:29","guid":{"rendered":"https:\/\/belzuz.com\/?p=21381"},"modified":"2026-05-27T13:45:54","modified_gmt":"2026-05-27T12:45:54","slug":"flash-news-amendment-to-the-labour-code-labour-xxi","status":"publish","type":"post","link":"https:\/\/belzuz.com\/en\/flash-news-amendment-to-the-labour-code-labour-xxi\/","title":{"rendered":"Flash News &#8211; Proposal for Amendment to the Labour Code \u2013 Labour XXI"},"content":{"rendered":"<ol>\n<li>\n<h3><strong> Digital Platforms, Artificial Intelligence, and Algorithms<\/strong><\/h3>\n<ol type=\"a\">\n<li><strong>Presumption of employment status on platforms: <\/strong>The indicators of subordination in digital platform work are clarified, namely regarding restrictions on organizational autonomy, control of working time, and limitations on the choice of clients.<\/li>\n<li><strong> Mandatory human intervention: <\/strong>The adoption of critical business decisions \u2014 such as recruitment, evaluation, career progression, or dismissal \u2014 based exclusively on algorithms or artificial intelligence becomes prohibited, and human intervention is always required to confirm, modify, or revoke the decision.<\/li>\n<\/ol>\n<\/li>\n<li>\n<h3><strong> Parenthood<\/strong><\/h3>\n<ol type=\"a\">\n<li><strong> Extension of initial leave: <\/strong>Initial parental leave may be extended up to 180 consecutive days. If the shared modality is chosen within the first 6 months, the initial parental benefit will be paid at 100% of the reference remuneration.<\/li>\n<li><strong> Father&#8217;s exclusive leave: <\/strong>The mandatory exclusive period for the father doubles to 28 days (to be taken within 42 days following the birth, 14 of which must be consecutive immediately after childbirth).<\/li>\n<li><strong> Gestational bereavement: <\/strong>In the event of termination of pregnancy, the female worker benefits from a leave of 14 to 30 days, granting the father the right to 3 consecutive days of justified absence.<\/li>\n<\/ol>\n<\/li>\n<li>\n<h3><strong> Termination of Employment Contract<\/strong><\/h3>\n<ol type=\"a\">\n<li><strong> Collective dismissal: <\/strong>Compensation is raised to 15 days of base pay and seniority increments (<em>diuturnidades<\/em>) for each full year of seniority. Additionally, the obligation to return the compensation received in order to legally challenge the dismissal is abolished.<\/li>\n<li><strong> Exclusion of reinstatement due to employer&#8217;s opposition: <\/strong>Should the court exclude reinstatement following an unfair dismissal (based on serious prejudice to the company), the substitute compensation is increased to values between 45 and 60 days of remuneration per year, with a guaranteed minimum of 6 months.<\/li>\n<li><strong> Non waivability of claims: <\/strong>Labour claims can no longer be extinguished by abdicative remission (waiver), unless formalized by a written statement recognized by a notary or if the worker is assisted by a member of the workers&#8217; commission.<\/li>\n<\/ol>\n<\/li>\n<li>\n<h3><strong> Organisation of Working Time and Location<\/strong><\/h3>\n<ol type=\"a\">\n<li><strong> Time bank by individual agreement:<\/strong> In the absence of a collective agreement, it becomes possible to establish a time bank by direct written agreement between employer and worker, allowing an increase of up to 2 hours per day (with a limit of 50 hours per week and 150 hours per year).<\/li>\n<li><strong> Right to disconnect: <\/strong>It is clarified that communications sent outside working hours with the express mention of &#8220;no reply required&#8221; do not violate the duty to abstain from contact.
