Supreme Court Judgment No. 1581\/2025, of 5 November"},"content":{"rendered":"<h2><strong>Context and subject matter of the judgment<\/strong><\/h2>\n<p>The judgment arises from a dispute concerning <strong>healthcare civil liability<\/strong> due to medical malpractice, where one of the issues at stake is <strong>the maximum amount for which insurers are liable<\/strong> in accordance with the terms of the policy.<\/p>\n<p>The key point is the coexistence of two clearly distinct limits:<\/p>\n<ul>\n<li>General limit per claim (total sum insured)<\/li>\n<li>Sub-limit per victim (lower amount applicable to each injured party)<\/li>\n<\/ul>\n<p>The essential question is to determine whether sub-limits are clauses delimiting risk or clauses limiting rights.<\/p>\n<p>Ultimately, the aim is to ascertain the applicable legal regime, its validity, and its enforceability against the injured party.<\/p>\n<h2><strong>Supreme Court doctrine: There is a key distinction between limit and sub-limit<\/strong><\/h2>\n<p>The Supreme Court establishes a fundamental distinction:<\/p>\n<p style=\"padding-left: 40px;\"><strong>a) Limit per claim<\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>It is a <strong>risk-delimiting clause<\/strong><\/li>\n<li>It defines the scope of the insurance (what it covers and up to what amount)<\/li>\n<li>It is fully valid without any special requirements<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><strong>b) Sub-limit per victim<\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>It is a <strong>rights-limiting clause<\/strong><\/li>\n<li>It reduces compensation within a risk already covered<\/li>\n<li>It does not define the risk, but rather <strong>restricts the right to compensation<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>The main legal consequence<\/strong> is that, as it is classified as a limiting clause, the sub-limit is subject to Article 3 of the Insurance Contracts Act (ICA), which means that the following requirements must be met:<\/p>\n<ul>\n<li>Clear and precise wording<\/li>\n<li>Special highlighting in the policy<\/li>\n<li>Express written acceptance by the policyholder<\/li>\n<\/ul>\n<h2><strong>The consequence of failing to meet these requirements is that the limit is NOT enforceable against the insured or the injured third party.<\/strong><\/h2>\n<p>I shall now discuss the effects of the judgment on insurance practice:<\/p>\n<h2><strong>The judgment consolidates a doctrine which:<\/strong><\/h2>\n<ul>\n<li>Breaks with the usual practice of including sub-limits without strict formalities.<\/li>\n<li>Reinforces the distinction between: Delimitation of risk and limitation of rights.<\/li>\n<\/ul>\n<h2><strong>All this has an impact on policies, as insurers must:<\/strong><\/h2>\n<ul>\n<li>Review the wording of policies<\/li>\n<li>Clearly highlight sub-limits<\/li>\n<li>Obtain the policyholder\u2019s express signature<\/li>\n<\/ul>\n<h2><strong>The consequence of failing to comply with these guidelines is that the sub-limit may be rendered ineffective, with the higher general limit applying.<\/strong><\/h2>\n<p>This Supreme Court ruling aims to strengthen protection for the injured party, preventing reductions in compensation, ensuring greater transparency and promoting full redress for the damage.
