Legal Flash – Update of Minimum Working Conditions for Administrative Employees

Ordinance n.º 306/2026/1 of 22 July (the “Ordinance”) has been published, introducing the eighth amendment to Ordinance n.º 182/2018 of 22 June, updating the working conditions applicable to administrative employees not covered by specific collective bargaining regulations.

Pursuant to the aforementioned Ordinance, the minimum monthly salary scale has been updated, reflecting an average increase of 6.2% across all levels, in line with the update of the Guaranteed Monthly Minimum Wage (GMMW) for 2026, set at €920.00, pursuant to Decree-Law n.º 139/2025 of 29 December.

The update of remuneration levels is intended to ensure compliance with Article 273 of the Portuguese Labour Code, which prohibits remuneration below the Guaranteed Monthly Minimum Wage.

The Ordinance applies exclusively to mainland Portugal, while the regulation of employment matters in the Autonomous Regions falls within the competence of the respective Regional Governments.

Although the Ordinance entered into force on 27 July 2026, the minimum monthly remuneration levels and other monetary provisions take effect from 1 March 2026.

The update of the minimum working conditions introduced by this Ordinance aims not only to ensure compliance with the Portuguese Labour Code but also to harmonize and enhance the working conditions of a significant number of administrative employees.

Failure to comply with the new remuneration scale, where applicable, may constitute a labour administrative offence, exposing employers to the payment of salary arrears and the imposition of potential fines.
